Defendant lucky to avoid jail after he had sex with under-age girl

A MAN of 20 who had sex with an under-age girl has been told he was lucky not to be jailed for several years.

Prosecutor David Gittins told Plymouth Crown court that Ross Luscombe had sex with the girl, using a condom, in April last year, and a week later engaged in a range of sexual acts with her in a bathroom until caught.

Luscombe, now 21 and of Lancaster Gardens, Whitleigh, pleaded guilty to two counts of sexual activity with a child under 16.

Judge Francis Gilbert QC told him: “This had more to do with satisfying your drunken and drug-fuelled lust than any romantic feeling.”

He sentenced Luscombe to 12 months in jail, suspended for two years with two years’ supervision by the Probation Service.

He also ordered a tagged 8pm-7am curfew for six months and ordered Luscombe to remain on the Sex Offenders’ Register for 10 years.

“This is a good deal better than going to prison for a couple of years,” he added. “You need quite a bit of help to sort yourself out.”
