Dad nabbed with child and dog abuse videos dodges jail
A dad caught with extreme videos of children being sexually abused and a dog being violated has avoided a prison sentence.
Allan Marsh, 50, was placed on the Sex Offenders’ Register and handed unpaid work and mandatory supervision.
He was also banned from all contact with children aged 17 or under without prior permission, and will have his internet usage strictly monitored.
Paisley Sheriff Court heard Marsh was convicted after trial of downloading and possession indecent images at his former home in the town’s Arthur Street.
Cops arrested him after visiting his home on January 29 last year.
Officers had received information that Marsh accessed files including video clips of girls as young as three being sexually abused.
His phone also contained footage of a dog being sexually violated shortly after giving birth.
The court heard he had admitted downloading “adult stuff” on his Samsung handset and claimed his phone has been hacked more than once in the last few years.
Sentence had been deferred until the court had obtained psychological and social work reports in preparation for handing him his punishment.
Defence agent Chris McKenna said Marsh, now of Causeyside Street , had been the target of anger in the community as well as from an ex partner following his conviction, and planned to move down south to Leeds for a “fresh start.”
He said: “He has encountered significant hostility from the community, members of his family and his ex-partner, who feels really vindictive towards him, since this information came to light.
“He is hoping to move to Leeds to start afresh with his new partner.
“If the court were to place him under an order it would be likely this order would be transferred to a new local authority.
“These are very serious images, but of a relatively low number, when compared to some of the cases which come before the courts.”
The lawyer said any risk of re-offending would be carefully managed by placing him under supervision.
Sheriff David Pender agreed with Mr McKenna, but voiced concern that sentencing guidelines were limited.
He said: “High court guidelines advise the imposition of an appropriate disposal given the low number of images, and I am obliged to comply with the guidelines, though it is not my view.
“As an alternative to custody I will impose three years of supervision. You will attended the Moving Forward, Making Changes programme, or any programme directed by your supervising officer.
“You will have no unsupervised contact with any children aged 17 or under.
“You will be placed on the Sex Offenders’ Register for three years and you will complete 300 hours of unpaid work.”
Marsh also had his internet usage restricted to approved devices, which are strictly monitored and incapable of storing any images.
He also cannot delete his search history and will appear at court on July 25 for a review of his conduct.

The 50-year-old Paisley creep claimed the files must have been put on his phone by a hacker.
But a jury saw through his lies and yesterday at Paisley Sheriff Court he was found unanimously guilty of downloading and possessing the catalogue of child and animal abuse over a five-year period.
Marsh, who moved from Causeyside Street, Paisley, to Paisley Road, Renfrew, was placed on the Sex Offenders’ Register.
Sheriff David Pender thanked the jury after they were subjected to what he described as a “very unfortunate and quite a distasteful case”.
In a video-recorded police interview, which was shown in court during his trial, Marsh said he was not sexually attracted to children and preferred women in their 50s.
He also said he thought the files found on his phone were “disgusting” and “sick” and said he would attack anyone who abused his own daughter.
Detective Constable Robert Urquhart, 39, told the court he searched the home Marsh shared with his then partner around 9am on January 29 last year, and they seized Marsh’s Samsung phone.
The court heard there were indecent images of girls as young as three being bound and abused and a video of the dog.
In the interview, DC Urquhart said: “There was a video of a medium-sized light brown dog coloured dog chained to a wall.
“The man is seen from his lower half, walking towards the dog.
“The dog looks scared as the man grabs the dog towards him.
“It appears the dog has recently given birth to a litter of pups as its teats are swollen, and pups are seen entering the scene.
“During the movie the man violently, and repeatedly, (hurts) the dog.”
In his defence, Marsh claimed: “The only thing I can think is they’ve been hacked.
“Anybody can download s*** to it if they hack it.
“A hacker can send s*** to my phone.
“I’ve not seen them, I didn’t know they were there.
“If I did know they were there I’d have reported it myself.”
Marsh will learn his fate next month when he returns to court for sentencing next month.
