Sex offender released by Appeal Court
A PAEDOPHILE who downloaded child porn and twice sexually assaulted a teenager as she strolled through parkland was freed by judges yesterday.
Mark Brook, 27, was put behind bars indefinitely for public protection at Nottingham Crown Court in August last year after he admitted two counts of sexual assault, one of possessing a bladed article and 16 of having child porn.
But Mr Justice Tugendhat, sitting with Lord Justice Stanley Burnton and Judge Stephen Gullick at London’s Criminal Appeal Court, overturned the open-ended sentence and replaced it with a community order.
Lawyers for Brook, of Woodbourne Road, Mapperley, pointed out that he had no previous sex-crime convictions and had already spent 15 months behind bars. Mr Justice Tugendhat said the public protection sentence was not appropriate in Brook’s case. The community order will include an “exclusion” order barring him from the area where the attacks took place and a condition that hecomplete a sex offenders’ treatment course.
